Terms of Service

These terms govern your use of ZemSignal. By creating an account or embedding the widget, you agree to them. If you're agreeing on behalf of an agency or brokerage, you represent that you're authorized to bind it.

The service

ZemSignal provides an embeddable widget that displays property risk information (flood zone, wildfire risk, storm history, earthquake risk, and related context) sourced from public government data, together with a lead-capture form, for use on independent insurance agency and real estate brokerage websites. Features and data sources may change over time.

Accounts & eligibility

  • You must be a licensed or actively operating insurance or real estate professional, or authorized staff of such a business.
  • Provide accurate account information and keep it current.
  • You're responsible for activity under your account and for keeping your credentials and API key secure. Rotate the API key if it's exposed.

Acceptable use

  • Embed the widget only on website domains you own or operate and have listed under your account.
  • Don't query the risk-lookup endpoint by automated or bulk means outside normal widget use, and don't resell or redistribute raw data access.
  • Don't remove or obscure required attribution, or misrepresent the source or nature of the data.
  • Don't use the service to build a competing property-data product, or to make or support insurance eligibility, underwriting, pricing, lending, or property-valuation decisions.
  • Comply with all laws that apply to how you contact and market to the leads you collect — including TCPA, CAN-SPAM, and applicable state privacy laws. How you follow up with a lead is your responsibility, not ours.

Not an official determination

Risk data shown by the widget is an informational estimate built from public data. It does not constitute an official flood zone determination, an insurance quote or underwriting decision, or a property appraisal or valuation. Public source data can be incomplete, outdated, or inaccurate. You must not represent the output as any of those things to a prospect, and the widget displays a disclaimer to that effect.

Leads & data responsibilities

Leads captured through your widget are delivered to you and are yours. As between you and ZemSignal, you are the controller of that data: you're responsible for having any notice or consent your jurisdiction requires, for honoring opt-out and deletion requests from those individuals, and for disclosing the widget in your own site's privacy policy. ZemSignal processes lead and address data on your behalf as described in the Privacy Policy.

Fees & billing

  • Paid plans are billed monthly in advance through Stripe. The plan you choose and its current price are shown at signup and in your dashboard.
  • Free trials convert to a paid plan at the end of the trial unless you cancel first.
  • Subscriptions renew automatically until cancelled. You can cancel anytime from the dashboard; access continues through the end of the period you've already paid for, and no refund or credit is given for the unused portion — a paid period can't be terminated early for a partial refund.
  • We may change plan pricing with at least 30 days' notice, effective at your next renewal.
  • Non-payment may result in the widget being paused until the balance is settled.

Intellectual property

ZemSignal owns the widget, the service, and its composite-score methodology. You own your brand assets and your leads. Underlying government datasets remain subject to their own public-domain or attribution terms (see the methodology page). You grant us the limited right to use your agency name and logo to render your branded widget and, unless you opt out, to identify you as a customer.

Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the data is accurate or complete or that the service will be uninterrupted or error-free.

Limitation of liability

To the maximum extent permitted by law, ZemSignal will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose.

Indemnification

You agree to indemnify ZemSignal against claims arising from your use of the service, your website, the content and branding you supply, and the way you contact or market to the leads you collect.

Termination

You may cancel your subscription anytime from the dashboard, and may request that your account be closed entirely by emailing us. We may suspend or terminate an account for breach of these terms, non-payment, or misuse. On termination, your right to use the widget ends; export your leads first. Sections that by their nature should survive (fees owed, disclaimers, limitation of liability, indemnification) survive termination.

Copyright complaints

If you believe content displayed through the service — including a widget's agency name, logo, or branding — infringes your copyright, email hello@zemsignal.com with a description of the work, the infringing material's location, and your contact information, and we will investigate and respond.

Governing law

These terms are governed by the laws of the State of Ohio, without regard to conflict-of-laws rules, and the state and federal courts located there have exclusive jurisdiction.

General provisions

  • Entire agreement. These terms and the Privacy Policy are the entire agreement between you and ZemSignal regarding the service, and supersede any prior agreements on the subject.
  • Severability. If any provision of these terms is found unenforceable, the rest remain in full effect.
  • No waiver. Our failure to enforce any provision isn't a waiver of our right to do so later.
  • Assignment. You may not assign these terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
  • Force majeure. Neither party is liable for delay or failure to perform caused by events outside its reasonable control, including outages of upstream government data sources, hosting, or payment providers.
  • Notices. We may notify you by email to the address on your account. You may notify us at hello@zemsignal.com.

Changes

We may update these terms. Material changes will be posted here with a new date and notified to agents by email; continued use after the effective date is acceptance.
